In any democratic society, the constitution serves as a bedrock upon which citizens' rights and freedoms are safeguarded. State officials carry a solemn responsibility to respect, defend, and uphold the Kenyan constitution by refraining from violating its principles, the right to protest is an essential component of citizen empowerment and collective expression. It serves as a powerful tool for citizens to voice their concerns, advocate for change, and hold their governments accountable. The protection of this right is not merely a favor bestowed by the state; rather, it stems from the recognition that individuals inherently possess certain freedoms which must be safeguarded, hence, we must appreciate and defend our constitution before its integrity weakens further.

 

Protests play a fundamental role in ensuring social justice and equality within societies worldwide . These demonstrations  serves as catalysts for transformative changes by drawing attention to marginalized groups or highlighting systemic injustices that need urgent redress . By granting people the freedom to express dissenting views through peaceful means such as protests, states reaffirm their commitment towards nurturing inclusive democracies.

 

Recent events have raised concerns about protecting the sanctity of our constitution's provisions regarding protests. Excessive use of force against demonstrators indicates an erosion of these crucial safeguards, Moreover, attempts at imposing restrictive legislation on public gatherings undermine citizens' ability to exercise their rights effectively – making them mere symbolic gestures designed solely for cosmetic purposes.

 

Preserving our constitutional protections related to protesting requires constant vigilance. If we fail to safeguard these rights, the door remains open for wider authoritarian measures that could silence dissent entirely . By acknowledging and asserting our constitution's values now, when it is relatively stable, we can ensure its longevity and strength in defending our democratic principles.

 

The right to protest is not a privilege granted by the state but an inherent human right that must be protected at all costs. As citizens passionate about upholding democracy and achieving social progress, it becomes imperative for us to defend our constitution vigorously before further erosion of its integrity occurs. By doing so today, we can secure a brighter future where citizen voices are amplified rather than stifled.

 

One central aspect underscoring effective governance is ensuring adherence to constitutional commitments made by state officials who pledge their loyalty towards upholding democracy's foundations. By doing so, they guarantee that all individuals within society enjoy equal treatment under just laws designed for their protection (Art 27).

 

Law enforcement agencies bear the fundamental duty of preserving peace and security; however, this mandate must not supersede or infringe upon citizens' constitutional rights during protests directed at expressing grievances or advocating change peacefully (Kenya Police Act §4). Rather than employing brutal tactics that instigate further tension between civilians and authorities such as live ammunition or tear gas canisters indiscriminately targeted at protesters solely exercising their nation-given right bestowed within Article 37(Assembly) hereof, authorities must emphasize effective communication and dialogue in order to deescalate conflicts.

 

When state officials neglect their role as defenders of the constitution by condoning or engaging in unlawful actions against protestors, it erodes public trust and undermines the social contract upon which democratic governance is established (Art 2). Failure to hold accountable those who violate constitutional rights perpetuates a culture where impunity thrives, fostering an environment hostile to democracy's core values.

 

 The Kenya National Police Service, under the leadership of the Inspector General, Japheth Koome, plays a crucial role in maintaining law and order while upholding constitutional principles. However, it is imperative that they remain impartial and not succumb to political pressures or misuse their authority for violent purposes.

A nonpartisan approach would prevent them from being swayed into perpetrating violence on behalf of rogue government officials seeking personal gain rather than serving public interests.

 

As custodians responsible for enforcing laws within society, it is incumbent upon  the Kenyan police service to strictly abide by constitutional provisions which are deemed supreme over any other legislation or executive action taken by authorities at all levels. By adhering firmly to legal frameworks outlined in these fundamental documents – such as freedom of assembly and peaceful demonstrations– policing entities can play an integral role in protecting citizen rights while still ensuring public safety remains unharmed throughout legitimate protests.

It is with great concern and dismay that we witness the brutal force being used by the police to suppress our right to protest peacefully, with live bullets and violence aimed at stifling our demands for justice and change. However, the people must not be deterred by such tactics. In the face of adversity, the people stand united, steadfast, and unyielding, ready to fight for their rights, human rights that are not granted freely but must be fought for, protected, and defended. The people should not relent, for they have nothing to lose but their fears.

 It is disheartening to witness the very institutions that are supposed to protect and serve the people turning against them with brutal force. The use of live bullets and violence against peaceful protestors is an egregious violation of our human rights. The government's attempt to instill fear in us and suppress our voices is a clear sign of their fear of our collective power to demand change. However, we must remember that fear cannot be the basis of a just and equitable society. Instead, it is unity, compassion, and resilience that shall lead us towards progress.

It is understandable that the escalating violence and oppression causes hesitation and fear among us. But it is precisely during these moments that we must stand strong and refuse to be silenced. We must remember the sacrifices of those who came before us, who fought relentlessly for the rights and freedoms we enjoy today. Their courage serves as a beacon of hope and inspiration, urging us to persevere in the face of adversity.

 

By resorting to brute force, the government believe they can crush our spirits and discourage us from protesting against the high taxation and the soaring cost of living. However, they must understand that these issues are not superficial grievances; they affect the very fabric of our society and the livelihoods of millions. Our protests are born out of necessity, and we cannot and will not allow ourselves to be silenced.

It is essential to reiterate that our struggle is a peaceful one. Non-violence does not indicate weakness; rather, it highlights the strength of our convictions and our commitment to justice. As we continue to protest peacefully, we demonstrate to the world the stark contrast between our cause and the brutality of the state. Kenya's constitution explicitly enshrines citizens' right to assembly and association under Article 37 ("The Constitution of Kenya").
